1. Who we are
TRADZEY LLC is a company registered and operating in the United States. The company runs an import trade desk and provides computer systems design and related technical services. The registered address is 4242 W 5700 S, Salt Lake City - 84118-5127, United States (US). The company can be reached by email at inquiries@tradzey.buzz and by telephone at +17799270169.
For the purposes of applicable data protection law, TRADZEY LLC is the controller of the personal information described in this policy. That means the company decides why information is collected, how it is used and how long it is kept. This policy is maintained by Tradzey, the developer responsible for the technical operation of this website and for the records described here. Where this policy refers to the company, it refers to TRADZEY LLC. Where it refers to the desk, it refers to the import trade desk operated by the company.
We have written this policy in ordinary English. It is long because it is meant to answer questions before they are asked. If any part of it is unclear, you are welcome to write to us and ask for an explanation, and we will reply in writing so that the answer can be kept with your records.
2. Scope of this policy
This policy applies to personal information that we collect through this website, through email and telephone contact with the desk, and through the administration of a trade file. It applies to information about prospective clients, current clients, supplier contacts, reference contacts, visitors to this website and anyone else who communicates with us about a file.
This policy does not apply to information held by other organisations. If you contact a carrier, a forwarder, a customs broker, a bank or a payment processor directly, that organisation will handle your information under its own privacy notice. We encourage you to read those notices, because the way another organisation handles your information is not within our control.
This policy also does not govern information that we process on the instructions of a client as part of a design or systems integration engagement, where the client remains the controller and we act only as a processor. In those cases the client privacy notice applies to the underlying personal information, and our obligations are set by the written agreement between the client and the company.
3. Information we collect
We collect information in several categories. The categories below describe what we hold in practice. We do not collect a category of information unless there is a reason connected to the work described in this policy.
Identity and contact information
This includes your name, job title, employer name, business email address, business telephone number and postal address. It also includes the details you provide in an enquiry, such as the goods you import, the origin of those goods and the stage your file has reached.
Correspondence
This includes emails, notes of telephone conversations, messages sent through the enquiry form and any attachments you send to us. We keep correspondence because a trade file depends on a written record, and because a later question is best answered by the document that was exchanged at the time.
Trade file information
This includes purchase orders, commercial invoices, packing lists, tagging sheets, freight quotes, classification notes, sample review records and landed cost sheets. Some of these documents contain personal information, such as the name of a signatory, a contact at a supplier or the name of an individual who approved a shipment.
Supplier and reference information
In the course of a vetting run we may record the name, role and business contact details of individuals at a supplier or at a reference organisation. We record only what is needed to evidence that a check was made and to allow the check to be repeated or challenged later.
Technical and usage information
When you visit this website, the web server may record your internet protocol address, the browser and operating system you use, the pages you request and the date and time of each request. This information is used to keep the site available and secure. We do not build advertising profiles from it.
Billing and financial information
Where a client engages us, we may hold company billing details, bank reference information and records of invoices issued and paid. We do not store full payment card numbers on this website, and this website does not process payments.
We do not knowingly collect special category information such as information about health, religion, political opinion or trade union membership. If such information reaches us incidentally, for example inside a document a client sends, we will not use it for any purpose and will ask the client to remove it.
4. How we collect information
Most information reaches us directly from you. You might send an enquiry through the contact form, write an email, telephone the desk or send documents by attachment. In each case you choose what to share, and we encourage you to share only what the work requires.
Some information reaches us from your organisation. A colleague may introduce you to the desk, or a client may name you as the person responsible for a shipment. In those situations we will confirm with you that you are the right contact and we will describe how we intend to use your details.
Other information reaches us from suppliers, forwarders, brokers and carriers as a normal part of trade paperwork. Their documents often name individuals, and those names form part of the file. We treat that information as confidential and use it only for the trade purpose it was provided for.
Finally, a limited amount of information is generated automatically when you use this website, as described in the section on technical and usage information. This information is generated by the server rather than supplied by you.
5. Why we use information
We use personal information for the following purposes. Each purpose is connected to the work described on this website, and we do not use information for unrelated purposes without a lawful reason and without telling you.
- To reply to enquiries and to decide whether we can help with a file.
- To open, maintain and close trade files, including vetting, consolidation, customs paperwork, quote comparison, sample review and landed cost audit runs.
- To prepare documents required for the movement of goods, including filings made with the authorities that apply to a shipment.
- To communicate with suppliers, forwarders, brokers, carriers and clients about a file.
- To keep a written record of decisions, findings and recommendations so that the file can be audited later.
- To issue invoices, collect payment and maintain accounting records.
- To meet legal, tax, customs and accounting obligations.
- To keep this website available, secure and operating correctly.
- To improve our services by reviewing how files were handled and where the process failed.
- To send occasional service updates to clients who have asked to receive them.
We do not sell personal information. We do not rent contact lists. We do not use client correspondence to train advertising models. The information you share with the desk is used to do the work you asked for and to satisfy the obligations that come with that work.
6. Lawful basis for processing
Where data protection law requires a lawful basis, we rely on one or more of the following. First, performance of a contract or steps taken at your request before a contract is formed, which covers most of the work done on a trade file. Second, compliance with a legal obligation, which covers customs, tax and accounting records that we are required to keep. Third, our legitimate interests in running a professional service, which covers replying to enquiries, maintaining records, preventing fraud and keeping the website secure, in each case balanced against your rights. Fourth, your consent, which we rely on for optional service updates and for anything else that is genuinely optional.
Where we rely on legitimate interests, we have considered whether the processing is necessary and whether it is proportionate. We keep the processing narrow. We do not use legitimate interests as a basis for advertising profiles, and we do not treat a business contact as a consent to marketing.
Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect processing that took place before the withdrawal, and it does not affect processing that relies on another basis, such as the record of a completed engagement.
8. Information in trade files
A trade file is the central record of an engagement. It may contain personal information about client staff, supplier staff and reference contacts, alongside commercial documents that are not about individuals at all. We treat the whole file as confidential, and we apply the same care to personal information inside it as we apply to the commercial terms.
Each file is owned by a named person at the desk. Access is limited to the desk owner, to colleagues who need to resolve a question on the file, and to any professional adviser engaged with the client consent. We do not circulate files for general interest, and we do not discuss one client file with another client.
Where a file contains a document that includes personal information about someone who did not send it to us, such as a named contact at a supplier, we record where the document came from and we use the information only to progress the file. If that person asks us to explain what we hold, we will respond as described in the section on your privacy rights.
When a file closes, it moves into our archive. The archive is retained because trade records are often needed years later, for example when a duty figure is questioned or when a supplier dispute is revisited. Retention periods are described below.
10. International transfers
Import work crosses borders by its nature. A file may involve a supplier in one country, a forwarder in another and a client in a third. Personal information therefore moves between countries as part of the work, and that movement is unavoidable if the file is to progress.
Where information leaves the country in which it was collected, we take steps to ensure it remains protected. Those steps may include contractual terms with the recipient, a review of the recipient security practices, and a restriction of the information shared to what the specific step requires. We do not send a whole file when a single document will do.
If you would like to know which countries are involved in a particular file, you may ask the desk owner and we will explain the route and the protections applied. Where a transfer would create a risk that cannot be adequately addressed, we will tell the client before the transfer takes place.
11. How long we keep information
We keep information for as long as it is needed for the purpose it was collected for, and for as long afterwards as the law or good practice requires. The periods below are our normal practice. A particular file may be kept longer where a dispute, an audit or a legal requirement justifies it.
Enquiries that do not become engagements are kept for up to twenty four months, so that we can recognise a returning contact and so that we can answer a question about what was discussed. Correspondence within an engagement is kept for the life of the file and then for the archive period.
Closed trade files are kept for seven years after the closing entry. Accounting and tax records are kept for the period required by United States law. Sample review records are kept with the file because they often answer a later question about a completed order. Server logs are kept for a short rolling period, normally no more than ninety days, unless they are needed to investigate a security incident.
When a retention period ends, information is deleted or irreversibly anonymised. Where deletion is technically difficult, for example because a record is embedded in an archive, we restrict access to the record and schedule the archive for destruction on a periodic cycle.
12. How we protect information
We apply administrative, technical and physical safeguards to personal information. Access to a trade file is restricted to the people who need it. Accounts are protected by strong credentials and are reviewed when a person leaves the desk. Documents are stored in services that encrypt data in transit and at rest, and archives are access controlled.
We train desk staff to recognise fraudulent requests, especially requests to change bank details or to release goods to an unverified party. A request that arrives unexpectedly is verified by a second channel before it is acted on, even when it appears to come from a known contact. This practice exists because trade documents are a frequent target for impersonation.
No system is perfectly secure. If a security incident occurs that is likely to result in a risk to your rights, we will notify the affected contacts and the relevant authorities as required by law, and we will explain what happened, what we have done and what you can do to reduce the risk.
If you suspect that a message claiming to be from the desk is not genuine, do not reply and do not open any attachment. Telephone +17799270169 to confirm whether the message came from us.
13. Your privacy rights
Depending on where you live, you may have some or all of the following rights. We will honour them where the law requires, and we will explain clearly if a request cannot be met in full.
- The right to be informed about how your information is used, which this policy is intended to satisfy.
- The right to request a copy of the personal information we hold about you.
- The right to ask us to correct information that is inaccurate or incomplete.
- The right to ask us to delete information, where there is no overriding legal reason to keep it.
- The right to ask us to restrict how information is used while a question is resolved.
- The right to object to processing that relies on legitimate interests.
- The right to receive information you provided in a portable format.
- The right to withdraw consent where processing relies on consent.
- The right not to be subject to a decision based solely on automated processing that has a legal or similarly significant effect.
- The right to complain to a data protection authority.
To exercise a right, write to inquiries@tradzey.buzz with enough detail for us to identify you and the information concerned. We may ask for proof of identity where that is necessary to protect the information from an unauthorised request. We respond within the period required by the law that applies, and normally within thirty days. There is no charge for a reasonable request, although we may charge a reasonable fee for a request that is manifestly unfounded or excessive.
Where we act as a processor for a client, we will forward your request to that client, because the client decides how the information is used. We will tell you when we have done so.
14. Privacy for Children
This website and the trade desk are intended for businesses and professional users. They are not directed at children, and we do not knowingly collect personal information from anyone under the age of sixteen. If you believe that a child has provided personal information to us, please write to inquiries@tradzey.buzz and we will delete the information promptly.
Where a document in a trade file names a young person, for example because a client has included a family member in a shipment record, we treat that information as confidential and use it only for the file purpose. We do not use it for marketing under any circumstances.
15. Marketing communications
We send service updates only to clients and contacts who have asked to receive them. We do not add an enquiry contact to a mailing list as a condition of replying. Every service update includes a way to stop receiving further updates, and a request to stop is honoured promptly.
We do not use personal information gathered from a trade file for marketing to anyone other than the client contact who engaged us. We do not pass contact details to partners for their own marketing. If you receive a message that appears to come from us and you did not ask for it, please tell us, because it may be an impersonation attempt.
16. Third party websites
This website may link to other websites, for example the website of a forwarder, a broker or a professional body. Those websites are operated by other organisations and are governed by their own privacy notices. We do not control their content or their handling of personal information, and a link does not imply that we endorse their practices.
If you arrive at this website from another site, that site may have collected information about you before you arrived. That collection is governed by the other site privacy notice, not by this policy. We encourage you to read the notices of any site that asks for your information.
17. Automated decision making
We do not make decisions about individuals using automated processing that has a legal or similarly significant effect. Supplier vetting, sample review and landed cost audit conclusions are reached by a person at the desk, and the reasoning is written into the file so that it can be reviewed and challenged.
Software assists the desk with document comparison and arithmetic, but a person reads the result before anything is filed. Where software flags a mismatch, a person decides what the mismatch means. This is a deliberate design choice. Import work has too many edge cases to be left entirely to a rule.
18. Changes to this policy
We review this policy at least once a year and whenever a material change occurs in how we handle information. When we make a change, we update the last updated date at the top of the page. Where a change materially affects how we use information already collected, we will notify affected contacts by email before the change takes effect, unless the change is required immediately by law.
Earlier versions of this policy are retained in our records. If you would like to see the version that applied at a particular date, write to inquiries@tradzey.buzz and we will provide it where that is reasonable.
19. Questions and complaints
If you have a question about this policy, or if you believe that your information has been handled improperly, please contact the desk first. Most concerns can be resolved quickly once we understand the facts, and we would rather hear about a problem early than discover it later.
When you write, include the file reference if you have one, a description of the concern and the outcome you are seeking. We will acknowledge the message, investigate the matter and reply in writing. If our reply does not resolve the concern, you may complain to the data protection authority of the country in which you live or work, or to the authority in the place where the alleged infringement occurred. We will cooperate with any such authority.
